Nvidia in agreement on false marketing of Geforce GTX 970

Shortly after Nvidia’s GTX 970 was released, reports were received that not everything was right with memory management. It turned out that 0.5 GB of the advertised 4 GB on the graphics card in the worst case could greatly degrade performance and was used as a result only in emergencies when the remaining 3.5 GB was filled.

As this part of the specifications was not communicated to the outside world, it did not take long before many felt cheated, which later led to a class action lawsuit for false marketing being brought against Nvidia and partner manufacturer Gigabyte.

Top Class Actions now reports that Nvidia agrees to a preliminary agreement, where all buyers of Geforce GTX 970 will be compensated with 30 dollars, corresponding to approximately 250 kronor at today’s exchange rates, and 1.3 million dollars in legal costs to plaintiffs. According to the company, there should be no upper limit for how much will be paid to consumers.

The agreement includes a total of 15 cases, including the case of the mentioned memory management. Another thing that is included in the lawsuits is that the card must have been said to have 64 raster units and 2 MB L2 cache, when the correct figures were 56 raster units and 1.75 MB L2 cache.

Instructions for how the compensation is to be demanded are not currently available, and as Swedish consumers could not be involved in the class action, they will not be able to take part in the compensation. However, most Swedish retailers agreed to repurchase or exchange in connection with the discovery of memory management.

Nvidia denies all allegations, but still agrees to the deal as it is believed to be the best solution for all parties.
