Moderna sues Pfizer and BioNTech for using its patent

WASHINGTON, Aug 26 – PRIME. Pharmaceutical company Moderna is suing Pfizer and BioNTech, alleging that they used patent-protected technologies to create a coronavirus vaccine.

Moderna is filing patent infringement lawsuits against Pfizer and BioNTech in the US District Court of Massachusetts and the Düsseldorf Court in Germany.

According to the release, “Moderna believes that Comirnaty’s COVID-19 vaccine developed by Pfizer and BioNTech infringes patents filed by Moderna between 2010 and 2016 relating to the underlying mRNA technology.” The pharmaceutical company claims that competitors copied the technology without permission. Moderna previously pledged not to apply patents related to anti-coronavirus drugs while the pandemic continues, but in March of this year, due to the establishment of a stable supply of vaccines, it changed its position, the report said.

The company expects competitors to compensate for the use of proprietary technologies, the report said. Moderna will not seek an injunction against the sale of Pfizer and BioNTech vaccines, the company says, nor will it seek damages for vaccine shipments to 92 low- and middle-income countries and for activities through March 8, 2022.
