Russian “daughter” of Google appealed the suspension of bankruptcy

MOSCOW, 24 Oct — PRIME. The Google LLC company, the Russian division of Google, filed a cassation appeal against the ruling of the Court of Appeal, which in September, at the request of Roskomnadzor, suspended the execution of the ruling of the Moscow Arbitration Court on the introduction of the initial bankruptcy procedure against it – supervision, follows from the published ruling of the court.

Consideration of the complaint was scheduled for Monday, but the meeting was adjourned for a week. Earlier in October, the suspension of monitoring was appealed by the arbitration manager Denis Poliychuk. The court will consider both complaints at the same time.

The court ruling on the introduction of surveillance in Google LLC, on the company’s own application, states that Poliychuk, a member of the Vozrozhdeniye union of arbitration managers, has been approved as the debtor’s interim manager. At the same time, when the operative part of the ruling was announced in court, it was announced that Vadim Kedrov from the Siberian Guild of Anti-Crisis Managers was being approved as an interim manager.

It also follows from the materials of the case that Kedrov filed an application with the court to correct the misprint and a motion to expedite the consideration of this application. He was denied a motion to speed up, but in the corresponding court ruling, he is also named the interim manager of Google

On September 26, the Ninth Arbitration Court of Appeal, at the request of Roskomnadzor, suspended the ruling of the first instance on the introduction of surveillance, issued on September 12, pending consideration of the agency’s appeal against this ruling. The press service of Roskomnadzor explained that this was due to the failure of the American company Google to pay the assigned turnover fine of 21.7 billion rubles for the repeated failure to remove illegal information. Consideration of the appeal of Roskomnadzor is scheduled for November 21.

Meanwhile, Kedrov, the Siberian Guild of Anti-Crisis Managers and the Vozrozhdeniye self-propelled guns also filed appeals against the decision of the Moscow Arbitration Court regarding the appointment of Poliychuk as the interim manager of Google. They will be considered simultaneously with the complaint of Roskomnadzor.

The court ruling on the introduction of monitoring states that, according to the debtor, the total amount of his monetary obligations to creditors exceeds 18.7 billion rubles, the debt for wages of employees exceeds 271 million rubles, and for mandatory payments – about 86 million. At the same time, Google has accounts receivable in the amount of more than 27 billion rubles, intangible and other assets – for a total amount of more than 3.8 billion.
